BROWN MURRAY – “1 IN 100” PROMOTION
TERMS AND CONDITIONS

1.    PROMOTER 

The Promoter, for the purposes of this promotion, is Richlight Pty Ltd (ACN 123 107 148) trading as Brown Murray (“the Promoter”). 

2.    ELIGIBILITY FOR DRAW 

Employees (and their immediate families) of the Promoter, and agencies associated with this Promotion are ineligible to enter into this Promotion. To receive an automatic entry into the draw, an entrant must satisfy all of the following criteria: 

2.1.    the entrant is over eighteen (18) years old; 

2.2.    the entrant is a registered proprietor of a property within Western Australia (“the Land”); 

2.3.    the entrant has entered into a Selling Agency Agreement with the Promoter on or after 1 November 2009, pursuant to which, the Promoter is authorised to market and sell the Land on the entrant’s behalf in return for a commission (“the Contract”); 

2.4.    pursuant to the Contract, the Promoter has procured a third-party buyer for the Land (“the Buyer”); and 

2.5.    the Land has settled, the Land is owned by the Buyer, and the Promoter has received its commission from the entrant, pursuant to the Contract.  

3.    PARTICIPATION 

Information on how to enter this Promotion, and information in relation to the prize, shall form part of these Terms and Conditions. Participation by the entrant in this Promotion shall constitute deemed acceptance of these Terms and Conditions. Upon satisfying the eligibility criteria contained within clause 2 of these Terms and Conditions, an entrant must sign an application form, obtainable from the offices of the Promoter, located at Suite 6, 10 Warton Road, Huntingdale (“the Office”).

4.    VERIFICATION
The Promoter reserves the right, at any time and its complete discretion, to verify the validity of entries and entrants (including an entrant’s identity, age and place of residence) and to disqualify any entrant who submits an entry that is not in accordance with these conditions of entry or who tampers with the entry process. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights. Incomplete, indecipherable or illegible entries will be deemed invalid.

5.    THE DRAW
Entries for this Promotion close upon receipt by the Promoter, at the Office, of exactly one hundred (100) valid entry forms. The Promoter reserves the right to accept more than one hundred valid entry forms in its sole discretion, although it shall not accept more than one hundred and ten entrants. Upon one hundred (100) entry forms being received by the Promoter, the Promoter shall write to each entrant, at the address contrained on the entry form, advising of the time and location of the draw, such draw to occur within 60 (sixty) days of receipt of the last entry form, and in a public place of the Promoter’s choosing (“the Draw”). The winner of the Prize will be notified by mail, and shall also be announced on the Promoter’s website. The Promoter’s decision at the draw is final and no correspondence will be entered into with any entrant or any other person whatsoever.

6.    THE PRIZE
The first valid entry drawn from the Draw will win the prize of $25,000.00, made payable by to that entrant by cheque (“the Prize”), and collectable from the Office.

7.    CLAIMING THE PRIZE

In the event that a winner of the Prize at the Draw does not collect the Prize from the Office, provided that the Promoter has written to the entrant at the entrant’s last known address and complied with clause 5 above, then the Promoter shall organise a further draw to be held within two months of the Draw, and shall advise the other entrants in the Promotion of the same.

8.    FURTHER DRAWS

The Promoter may conduct such further draws at such time at the Office or any other public place as it considers, as are necessary in order to distribute the Prize, subject to any written directions from a regulatory authority.

9.    INTERFERENCE

If this Promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated, due to any reason beyond the reasonable control of the Promoter, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law to:

9.1.    disqualify any entrant; or

9.2.    subject to any written directions from a regulatory authority, modify, suspend, terminate or cancel the Promotion, as appropriate.

10.    COSTS

Any costs associated with entering into the Promotion are the entrant's responsibility.

11.    LIABILITY

Except for any liability that cannot be excluded by law, the Promoter (including its officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the Promotion, including, but not limited to, where arising out of the following:

11.1.    any technical difficulties or equipment malfunction (whether or not under the Promoter’s control);

11.2.    any theft, unauthorised access or third party interference;

11.3.    any entry or Prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter;

11.4.    any tax liability incurred by a winner of the Prize or entrant; or

11.5.    use of the Prize.

12.    PROPERTY

All entries remain the property of the Promoter. The Promoter collects entrants' personal information in order to conduct the Promotion. If the information requested is not provided, the entrant may not participate in the Promotion. Entrants' personal information may be disclosed to State Lottery Departments and winners' names published as required under the relevant State lottery legislation. A request to access, update or correct any information should be directed to the Promoter at Office.

13.    GOVERNING LAW

These Terms and Conditions shall be governed by the laws of Western Australia.

14.    DISCRIMINATION

In the event that any part of these Terms and Conditions should be constructed as discriminatory, they should be read and construed with that part deleted.

15.    SEVERABILITY

In the event that part or all of any provision of these Terms and Conditions are illegal or unenforceable, that part or all of any provision may be severed from these Terms and Conditions and the remaining provisions will continue in full force and effect.
